PRIVACY POLICY

This Privacy Policy (the “Policy”) defines the procedure for collecting, storing, and using the information and personal data of visitors to the website givingtuesday.ua (the “Site”), owned by NGO Zagoriy FOUNDATION (EDRPOU code 45425394, located at: 01010 Kyiv, 32/2 Ostrozkykh Knyaziv Str.), registered under Ukrainian law (the “Organisation”).

The owner and manager of the personal data of the website users is NGO “Zagoriy FOUNDATION “.

By using the Site (browsing web pages, clicking links, filling out registration forms, applications, questionnaires, etc.), the user consents to the collection, storage, and use of their information and personal data by the Organisation in accordance with the terms of this Policy. The user confirms that they have read and understood the procedures, purposes, and conditions of personal data use in accordance with Articles 6, 8, 10, and 11 of the Law of Ukraine “On Protection of Personal Data”. If the user disagrees with the terms of the Policy, they should immediately leave the Site.

The user confirms that they are legally capable and have the authority to consent to the processing of personal data as specified in this Policy or any forms, applications, or registration provided on the Site. If the necessary legal capacity is lacking, consent has been provided by the user’s parents, guardians, or legal representatives.

By accepting this Policy, the user agrees to the processing of applications, questionnaires, registration forms, and other personal data they provide when filling out forms on the Site to 1) use the Site, 2) participate in events organized by the Organisation, 3) explore cooperation or partnership opportunities with the Organisation.

This Policy only applies to information collected on the Site.

1. DEFINITIONS

Use of personal data: Any action taken by the owner to process, protect, or grant partial/full rights to process personal data to third parties with the consent of the data subject or in accordance with the law.

Personal Data: Any information that relates to an identified or identifiable individual.

Information: Data stored on material or digital media.

Personal Data Subject: An individual (website user) whose personal data is being processed.

2.1. The Organisation collects and processes automatically collected information and personal data when using the Site.

2.2. Automatically collected information includes:

2.3. Personal Data: The Organisation collects personal data (name, email, phone number, social media links, location, company name, etc.) provided voluntarily by users to use the Site, with consent as per this Policy.

The Organisation does not collect sensitive personal data such as racial or ethnic origin, political beliefs, health data, etc., as per Article 7 of the Law of Ukraine “On Protection of Personal Data”.

 

3. PURPOSE OF COLLECTING, STORING AND USING INFORMATION AND PERSONAL DATA

3.1. Information and personal data are collected, stored, and used for:

• Providing information upon request
• Processing requests, registration forms, and applications
• Sending emails with promotional materials, charitable project updates, or invitations to provide feedback
• Any other purpose outlined in this Policy

5.1. The user has the right to:

• Request modification or deletion if the data is processed unlawfully

• File a complaint to the Commissioner or court regarding the processing of personal data

6. VALIDITY OF THE POLICY

6.1. This Policy is effective from June 17, 2024.

6.2. The Organisation may amend or update this Policy at any time, with updates taking effect from their publication.

6.3. If any part of this Policy is invalid, the rest of the Policy remains in full force.
